TrawlingWeb's legal framework
We operate under Article 4 of EU Directive 2019/790 and Article 67 bis of the Spanish IP Law. This page sets out our legal position for clients, partners and rightholders. The detailed legal documentation is handled by our legal team.
Regulatory framework
TrawlingWeb's activity is covered by the Text and Data Mining exception set out in:
- Art. 4 Directiva (UE) 2019/790 — General European exception for TDM on lawfully accessible works and material.
- Art. 67 bis LPI — Transposition into Spanish law.
These rules authorise reproduction and extraction of data for analysis purposes, provided access is lawful and rightholders have not expressly reserved their rights through machine-readable means.
Nature of what we deliver
Our products do not redistribute original editorial content; they deliver an AI-generated derived transformation that does not substitute for the source.
The text stored in TrawlingWeb's systems is not the original content as published by the rightholder. It is an AI-transformed interpretation — cleaning, normalisation, semantic enrichment, and summarisation — representing roughly 80–90% processing compared to the source.
Respect for rights reservations
The TDM exception applies only if rightholders have not expressly reserved their works. TrawlingWeb implements mechanisms to detect and respect machine-readable opt-outs (robots.txt, standardised metadata).
Rightholders who wish to reserve their rights against our activity can reach us through a direct contact channel.
Responsibility and the client
TrawlingWeb is responsible for the nature of the processing and for compliance with the TDM framework. The client is responsible for the use it makes of the analyses and data it receives. Commercial contracts explicitly set out this delimitation.
